Real Estate Law

Most people associate real estate law with closings, however it encompasses many more areas.  I have assisted clients through all stages of real estate development, including pre-acquisition due diligence, financing, land use and entitlements, project structuring, drafting restrictions and condominium declarations, setting up associations, and residential and commercial closings.  Many real estate attorneys focus only on providing either transactional services or litigation services, however my background in both provides me with a unique perspective in which to address client issues.

Litigation

I can assist with prosecuting or defending a variety of different legal actions for clients, including breach of contract, loan document enforcement, foreclosure, post-judgment collections, restrictive covenant enforcement, condominium and homeowner association litigation, lease enforcement and evictions, land use litigation, easements, boundary disputes, quiet title, and partition actions, to name a few.  My goal is always to achieve the clients’ goals in a cost-effective manner.  To that end, I attempt to educate clients on the lawsuit procedure, potential outcomes and expected cost of their matter so they know what to expect.  I also explore pre-suit settlement of disputes when possible, because sometimes the better choice is not to litigate a dispute at all.  However, when a lawsuit is required, I provide vigorous representation to achieve the clients’ desired outcome.

Homeowner & Condominium Association Law

Operating and managing a condominium or homeowner association today is equivalent to operating a small to medium size business.  In addition, associations are highly regulated through a substantial framework of statutes, case law and administrative rules that change frequently.  Officers and directors of associations, and their management companies, need counsel that understands the legal framework and issues facing them.  I have represented both condominium and homeowner associations for the last decade in all aspects of operations, including managing day-to-day issues, legal opinions, covenant drafting and amendments, assessment or covenant enforcement actions, defending lawsuits against associations and understanding and implementing changes in the laws.

Landlord/Tenant

I represent both residential and commercial landlords and tenants with the issues that affect them.  I can assist the landlord or the tenant with lease negotiations and drafting.  I also assist landlords and tenants in lease enforcement actions, including breach of lease, evictions, eviction defense and seeking monetary damages for unpaid rent. 

Banking

I have represented numerous banking clients in loan structuring and due diligence, residential and commercial closings, loan document drafting and review, loan enforcement, foreclosures, loan workouts and post-judgment collections.

Business Law

I can advise and assist clients through a wide range of general business matters, including entity formation and operation, entity or asset transfers, contract drafting and review, financing matters, and general counsel on everyday business decisions.  If the business is required to pursue litigation to enforce or defend contractual or other rights, I have extensive experience assisting clients through these matters as well.
